Overview
This website is operated by Fern & Wild (“Fern & Wild”, “we”, “us”, “our”). By using this site or placing an order, you agree to these Terms of Service together with our Privacy Policy, Returns & Exchanges and Shipping & Delivery policies.
We may update these terms by posting changes on this page. Your continued use of the site after changes are posted constitutes acceptance.
Eligibility
You must be at least 18 years old or have consent from a parent or guardian to use this site and place orders. You may not use the site for unlawful purposes or to transmit harmful code.
Products and pricing
All prices are in South African Rand (ZAR) unless stated otherwise. We strive to display accurate product information, but images of plants are a guide only — live stock varies in size, shape and season. We may limit quantities, refuse orders, or discontinue products at our discretion.
Prices and availability may change without notice. If we discover an error after you order, we may cancel or adjust the order and will contact you.
Live plants and farm stock
Fresh flowers, cut stems, bouquets and seeds are living or perishable goods. They are not returnable for change of mind once dispatched (or once a seed packet is opened). By placing an order, you acknowledge this and our Returns & Exchanges policy.
Some products may not be available for courier delivery to all provinces. Restrictions are shown at checkout.
Orders and payment
When you place an order, you offer to buy the goods at the prices shown. We confirm acceptance when we send an order confirmation email or dispatch your order.
Payment options shown at checkout may include credit or debit card (via Yoco) and manual electronic bank transfer (EFT). EFT orders remain pending until we confirm payment in our bank account. Card payments are processed securely by Yoco; we do not store your full card details.
You must provide accurate billing, contact and delivery information.
Shipping and delivery
Courier delivery and collection options are described in our Shipping & Delivery policy. Delivery times are estimates, not guarantees. Once your order is handed to the courier, transit is the courier’s responsibility, subject to our transit-damage policy.
Returns and refunds
Returns are handled according to our Returns & Exchanges policy and applicable South African law, including the Consumer Protection Act and the Electronic Communications and Transactions Act. Your statutory rights are not excluded.
Accounts and communications
If you create an account, you are responsible for keeping your login details secure. We may send transactional emails about your orders. Marketing emails are sent only if you opt in.
Content you submit (reviews, comments, contact messages) must be lawful and accurate. We may use your submissions to operate the site and respond to you.
Intellectual property
Site content, branding, images and text are owned by Fern & Wild or our licensors. You may not copy, scrape or resell site content without our written permission.
Third-party links
Our site may link to third-party websites. We are not responsible for their content or policies.
Disclaimer and liability
The site and products are provided as available. To the fullest extent permitted by South African law, we disclaim implied warranties not required by law. We are not liable for indirect or consequential loss, except where the law does not allow such exclusion.
Our total liability for any claim relating to an order will not exceed the amount you paid for that order, except where the law requires otherwise.
Indemnity
You agree to indemnify us against claims arising from your breach of these terms or misuse of the site, except to the extent caused by our negligence or misconduct.
Governing law
These terms are governed by the laws of the Republic of South Africa. You agree to the jurisdiction of the courts of Gauteng, South Africa.
